Essential Consumer Protection & Due Diligence Guide

Purchasing a manufactured home—especially within an age-restricted, land-lease community—is very different from buying a traditional stick-built home. Because you are buying the dwelling while leasing the underlying land, thorough due diligence is vital to protect your investment, your equity, and your lifestyle.

Before you make an offer or sign a contract, review these critical consumer protection checkpoints:

1. Land-Lease vs. Real Property (Know What You Own)

  • Space Rent & Market Rates: When you buy in a land-lease community, you own the home, but you pay monthly rent for the lot. Space rent can increase, and "market rate" rent for a new buyer may be higher than what the current seller pays. Always verify current lot rent, inclusion of utilities, and historical rent trends directly with park management.

  • Community Approval Required: Purchase contracts in land-lease communities are strictly contingent upon receiving formal park approval. You must complete a residency application, background check, and financial review with community management before closing.

2. Financing & Chattel Loans (Home-Only Financing)

  • How Chattel Loans Differ: Because you are purchasing the home without buying the underlying real estate, traditional mortgage programs generally do not apply. Financing for land-lease manufactured homes is known as a Chattel Loan (a personal property loan secured strictly by the home itself).

  • Lender Availability & Terms: Financing options are specialized. There are only a few larger underwriters, select portfolio lenders, and a single bank in our area offering home-only loans. These loans typically feature higher interest rates and shorter repayment terms compared to standard real estate mortgages.

  • Debt-to-Income Calculation: When underwriting your loan, chattel lenders will factor the community’s base space rent directly into your Debt-to-Income (DTI) ratio.

  • Critical Questions for Your Lender: Always ask if origination fees, points, and third-party closing costs can be rolled into the loan or if they must be paid out-of-pocket, and confirm your exact required cash to close. (We can refer you to experienced, specialized chattel lenders who can answer your specific financial questions).

3. State Regulation: Arizona Department of Housing (ADOH)

  • Legal Protections & Oversight: The Arizona Department of Housing (ADOH) oversees licensing and regulatory enforcement for manufactured housing in Arizona.

  • Landlord & Tenant Act: ADOH administers and oversees the statutory guidelines set forth in the Arizona Residential Mobile Home Parks Landlord and Tenant Act (A.R.S. Title 33, Chapter 11). This Act dictates the rights, duties, and legal obligations of both park owners and tenants, including rule changes, eviction procedures, space rent increases, and health and safety standards.

4. Physical Home Inspections & Standards

  • Independent Professional Inspections: Never skip a professional inspection. We strongly advise hiring an inspector experienced in manufactured housing construction, tie-down anchoring systems, evaporative coolers, HVAC systems, and plumbing (such as Polybutylene piping).

  • HUD Code vs. Pre-HUD Homes: Homes built prior to June 15, 1976 (pre-HUD) carry different structural standards, financing limitations, and insurance requirements than HUD-code homes built after that date.

5. Community Compliance & Rules Audit

  • Point-of-Sale Park Inspections: Many communities conduct their own health and safety inspection prior to title transfer. Any site violations (e.g., shed compliance, carport alterations, paint colors, or landscaping) must be cured before park approval is granted.

  • Rules & Regulations: Review the community's Rules & CCRs thoroughly. Verify age-restriction compliance (such as the 80/20 rule), pet count/breed limits, vehicle parking restrictions, and subleasing policies.

6. Title, Taxes, and Escrow Protection

  • Title Transfer: Mobile and manufactured homes on leased land are transferred via title through the Arizona Department of Transportation (MVD) or Department of Housing, not standard real estate deeds.

  • Escrow Safety: Ensure funds, earnest money, and transaction documents are handled through a licensed title and escrow company or qualified housing broker to guarantee clear title transfer and proper lien payoff.
